Massachusetts Passes Law Allowing ADU's By Right State-Wide

As of August 1, 2024, Massachusetts single-family homeowners may add an Accessory Dwelling Unit (ADU) to their property By Right. The law also prevents local municipalities from imposing special permit requirements or owner-occupancy requirements. While local governments can still regulate the use of short-term rentals of ADUs, they may not prohibit long-term leases. This is part of Governor Maura Healey's Affordable Homes Act (AHA), the largest housing bond bill the state has ever seen.
